Kim Kardashian wins $4m from Missguided fashion brand

Reality TV and social media star Kim Kardashian West has won US$2.8 million from a fashion brand which she claimed used her “persona” to sell clothes.

A default judgment handed down by a California judge this week ordered fashion company Missguided USA to pay Kardashian West US$2.7 million in damages and another US$59,600 in attorney fees - close to AU$4 million - after Missguided failed to respond to a lawsuit lodged by Kardashian West’s attorneys, according to TMZ.

The lawsuit claimed Missguided was using Kardashian West’s “persona and trademarks” to sell clothes, and argued repeated tagging of Kardashian West in posts advertising similar outfits to ones she had warned was proof of this.

The judge agreed, declaring that Missguided had “repeatedly used Kardashian’s name and likeness without permission on its social media platforms to promote the sale of its clothing”.

Kardashian West filed the lawsuit in February this year, just weeks after she publicly called out Missguided for selling and making clothes that were practically identical to her own.

“Fast fashion brands, can you please wait until I wear this in real life before you knock it off?” Kardashian West said.

The verdict comes after a tricky week for Kardashian West, with her bodywear line - “Kimono” - described as racist and problematic. Kardashian West has since backed down and will change the name.
